This Privacy Policy for FactualIQ (“we,” “us,” or “our”) describes how and why we collect, store, use, and share your personal information when you use our services, including when you visit factualiq.ai, receive or view a FactualIQ pitch or proposal, or engage with us in connection with sales, marketing, or other communications.

1. What information do we collect?

Information you provide to us. We collect personal information you voluntarily provide when you express interest in our services, fill out a contact or demo request form, or otherwise communicate with us. This may include your name and email address.

Information collected automatically through analytics tools. After you consent to analytics through our cookie consent banner (see Section 5), we collect technical information about your visit — browser type, operating system, device type, referring URLs, and how and when you interact with our pages. Our analytics run through a first-party proxy on our own domain, and we do not collect or transmit your IP address to our analytics provider.

Server logs. Like most websites, our web host may record your IP address in standard server logs for security, fraud-prevention, and operational purposes. These logs are kept only transiently, are not linked to your identity, and are not used for analytics, profiling, or advertising.

Information collected through pitch materials. When we share a FactualIQ pitch deck or proposal with you directly and you accept analytics through the consent banner in that material, we may collect information about whether and how you viewed it. This information is linked to the specific communication we sent you, not to anonymous browsing. Recipients who decline are not tracked.

We do not collect sensitive personal information (racial or ethnic origin, health data, financial account details, biometric identifiers, or similar categories).

2. How do we process your information?

We process personal information only when we have a valid reason to do so. Reasons include:

• Providing and improving our services
• Responding to your inquiries and support requests
• Sending marketing communications you have opted into (you can opt out at any time)
• Understanding how our website and materials are used so we can improve them
• Security, fraud prevention, and legal compliance

3. When and with whom do we share your personal information?

We may share your personal information with:

Service providers. Third-party vendors who perform services on our behalf — such as website hosting, email delivery, and analytics — under written contracts that restrict how they may use your data.

Business transfers. In connection with a merger, acquisition, or sale of company assets, your information may be transferred as part of that transaction.

Affiliates. Affiliated entities under common ownership or control with FactualIQ, who are required to honor this policy.

We have not sold personal information to third parties in the preceding twelve months.

The categories of service providers with whom we may share data include: website hosting providers, analytics services, email and communication tools, and sales and marketing platforms.

4. Do we use cookies and other tracking technologies?

Yes, in limited ways. We use cookies and similar technologies to maintain site security, save your preferences, and — after you consent — collect analytics data about how visitors interact with our site.

We do not use cookies for targeted advertising or retargeting. We do not share cookie data with advertising platforms.

Your consent controls what fires. Analytics cookies and scripts are blocked until you interact with our consent banner. If you decline, no analytics cookies are set and no analytics data is transmitted. You can change your choice at any time by clearing your browser cookies and revisiting the site, which will prompt the banner again.

Most browsers allow you to refuse or delete cookies through browser settings. Doing so may affect some site functionality.

5. Analytics and session replay

Amplitude Analytics. We use Amplitude to understand how visitors interact with factualiq.ai and with pitch materials we share directly. Amplitude is configured to route data through a first-party proxy on our own domain, and we do not transmit your IP address to Amplitude. Amplitude does not load or collect any data until you have accepted analytics through our consent banner.

Session replay. We do not currently use session replay on factualiq.ai or in our pitch materials, and no visual recording of your browsing is captured. If we enable it in the future, it will be subject to the same consent gate as analytics, and password fields, payment fields, and text-input areas will be masked and never recorded.

Pitch deck analytics. When we share a pitch deck directly with a named recipient, we may track whether and how it was viewed. This tracking fires only after the recipient accepts analytics through the consent banner embedded in the deck. Recipients who decline are not tracked.

Opting out. Decline analytics through our consent banner, or clear your browser’s local storage and cookies to reset your consent choice.

6. California residents — CIPA and your privacy rights

California Invasion of Privacy Act (CIPA). CIPA prohibits the interception of electronic communications without the consent of all parties. We designed our analytics implementation specifically to address this. No analytics script is loaded, initialized, or allowed to write to your browser before you consent. This applies to both factualiq.ai and to any FactualIQ pitch decks you receive.

If you are a California resident and decline analytics tracking, no data about your session is collected, transmitted to Amplitude, or retained in any analytics system. Only server-side access logs (standard web server logs) may record your visit, as is standard for all web traffic.

Shine the Light (California Civil Code § 1798.83). California residents may request, once per year at no charge, information about categories of personal information we disclosed to third parties for direct marketing purposes. We do not currently share personal information with third parties for direct marketing. To submit a request, contact us at [email protected].

7. How long do we keep your information?

We keep personal information only as long as necessary for the purposes described in this policy, unless a longer period is required by law. When information is no longer needed, we delete or anonymize it. Information stored in backup systems is isolated and not actively processed until deletion is possible.

8. How do we keep your information safe?

We have implemented technical and organizational security measures appropriate to the nature of the information we collect. These include access controls, encrypted transmission, and regular review of our data practices.

No internet transmission or storage system is perfectly secure. We cannot guarantee that unauthorized third parties will never defeat our security measures. You access our services at your own risk, and we encourage you to use secure network connections.

9. Do we collect information from minors?

No. Our services are not directed to individuals under 18 years of age and we do not knowingly collect their personal information. If you believe we have inadvertently collected information from a minor, contact us at [email protected] and we will promptly delete it.

10. What are your privacy rights?

Withdrawing consent. If we are processing your personal information based on your consent, you may withdraw that consent at any time by contacting us. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.

Opting out of marketing. You may unsubscribe from marketing emails at any time using the unsubscribe link in any email we send, or by contacting us directly. You will still receive transactional communications necessary for services you have engaged.

Analytics consent. You may decline or withdraw analytics consent through the consent banner on our website or in any FactualIQ pitch deck you receive.

11. Controls for Do-Not-Track features

Most browsers include a Do-Not-Track (DNT) signal. No uniform technology standard for implementing DNT has been finalized. We do not currently respond to DNT signals automatically. California law requires us to disclose this practice, and we do so here. If a recognized standard is adopted, we will update this policy accordingly.

12. United States residents — state privacy rights

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have specific privacy rights under applicable state law, including:

• Right to know whether we are processing your personal data
• Right to access your personal data
• Right to correct inaccuracies in your personal data
• Right to request deletion of your personal data
• Right to obtain a copy of personal data you previously shared with us
• Right to non-discrimination for exercising your rights
• Right to opt out of targeted advertising, sale of personal data, or profiling with significant legal or similar effects

Some additional rights apply only in specific states (Minnesota, Oregon, California, Delaware, Maryland, Florida) as permitted under those states’ laws.

How to exercise your rights. Submit a request by emailing [email protected] or by visiting factualiq.ai. We will verify your identity and respond in accordance with applicable law. If you use an authorized agent, we may require written proof of authorization.

Appeals. If we decline your request, you may appeal by emailing [email protected]. If your appeal is denied, you may file a complaint with your state attorney general.

Categories of personal information collected in the past 12 months:

We do not sell personal information. We do not share personal information for cross-context behavioral advertising.

13. Do we make updates to this policy?

Yes. We may update this policy as our practices change or as law requires. When we make material changes, we will update the “Last updated” date at the top of this page. We encourage you to review this policy periodically.
